This Affiliate Program Agreement (“Agreement”) contains the complete terms and conditions between H2HOSTY PRIVATE LIMITED (“H2Hosty”, “we”, “us”, “our”) and the Affiliate (“you”, “your”, “Affiliate Partner”) regarding your participation in the H2Hosty Affiliate Program (“Affiliate Program”).
By applying for or participating in the Affiliate Program, you confirm that you have read, understood, and agreed to be bound by this Agreement and our general Terms of Service.
1. DEFINITIONS
“Affiliate” – Any individual or entity applying to or participating in the Affiliate Program.
“Affiliate Dashboard” – The online interface where Affiliates can track commissions, conversions, and update information.
“Affiliate Link” – The unique tracking link assigned to each Affiliate to promote H2Hosty services.
“Qualified Purchase” – A valid sale of an eligible H2Hosty product made through a tracked Affiliate Link that meets the conditions stated in this Agreement.
“Commission Fees” – The amount payable to the Affiliate for each Qualified Purchase.
“Commission Threshold” – The minimum amount ($100 USD) that must be accrued before payout.
“Referred Customer” – A new, unique customer referred via the Affiliate Link who provides valid contact and payment details and is in good standing after the refund period.
“H2Hosty Services” – The web hosting and related products available for sale through H2Hosty’s website.
“Affiliate Platform” – The internal or third-party system used to manage tracking, analytics, and payments.
2. ENROLLMENT IN THE PROGRAM
To join the Affiliate Program, you must complete the Affiliate signup form available on our website.
All applications are reviewed within 5–7 business days. H2Hosty reserves the right to accept or reject any application at its sole discretion.
Reasons for rejection may include, but are not limited to:
– Use of unlawful, deceptive, or spam-based marketing practices.
– Content containing hate speech, adult material, or copyright violations.
– Websites deemed inappropriate or misleading.
If rejected, you may not reapply using the same domain or re-submit with alternate details to bypass rejection.
3. AFFILIATE RESPONSIBILITIES
You must:
- Provide accurate and up-to-date contact, tax, and payment information.
- Promote H2Hosty ethically, without misleading claims or unauthorized incentives.
- Avoid self-referrals — purchases made through your own affiliate links are prohibited.
- Refrain from spam tactics, fake traffic generation, or cookie stuffing.
- Use only approved banners, logos, and creatives provided by H2Hosty.
- Disclose affiliate relationships in accordance with the Indian Advertising Standards Council (ASCI) and FTC guidelines for transparency.
- Maintain good faith referrals and avoid fraud, misuse, or deceptive practices.
Violation of these obligations will result in termination and forfeiture of unpaid commissions.
4. APPROVED PROMOTION METHODS
You may promote H2Hosty using approved materials such as banners, text links, and graphics provided in the Affiliate Dashboard.
The following methods are strictly prohibited:
- Unauthorized use of H2Hosty trademarks or variations in domains, ads, or metadata.
- Pay-per-click bidding on H2Hosty brand names or misspellings.
- Email spam, pop-ups, incentivized clicks, or fake coupons.
- Misleading content implying partnership, ownership, or endorsement by H2Hosty.
- Use of adult, hate, or illegal content.
H2Hosty retains full discretion to determine what constitutes inappropriate promotion.
5. COMMISSION STRUCTURE
Commissions apply only to the initial purchase of eligible services through valid Affiliate Links.

Additional Terms:
- No commissions for renewals, upgrades, or downgraded plans.
- No commissions on refunded or cancelled orders.
- Maximum commission per sale may be capped at $300 USD.
- Commissions are calculated excluding taxes and fees.
6. COMMISSION HOLD & VALIDATION PERIOD
Commissions are held for 45 days after the sale date to account for the 30-day money-back guarantee and fraud checks.
If the customer cancels or requests a refund during this period, the corresponding commission will be voided.
H2Hosty reserves the right to withhold payment or reverse commissions in cases of:
- Fraudulent or duplicate referrals,
- High cancellation rates,
- Self-purchases, or
- Breach of this Agreement.
7. PAYMENT TERMS
- Minimum payout: $100 USD.
- Payments are released after the 45-day validation period.
- Commissions are paid monthly in USD.
- Payouts are processed via approved digital payment methods listed in the Affiliate Dashboard.
- You must maintain valid payment and tax details to receive payments.
- H2Hosty is not responsible for transaction or bank fees incurred by the Affiliate.
Unclaimed or unwithdrawn commissions older than 24 months will be voided.
8. RELATIONSHIP OF PARTIES
Both parties are independent contractors.
This Agreement does not create any partnership, joint venture, employment, or agency relationship.
You may not represent yourself as an employee or agent of H2Hosty.
9. TERM AND TERMINATION
This Agreement remains in effect from the date of acceptance until terminated.
H2Hosty may terminate your participation:
- With 7 days’ notice for any reason, or
- Immediately, without notice, if you violate these Terms.
Upon termination:
- Outstanding commissions pending validation will be forfeited.
- All H2Hosty trademarks, banners, and materials must be removed within 3 business days.
- You lose all rights to use the H2Hosty brand or claim affiliation.
10. CONFIDENTIALITY
All non-public information provided by H2Hosty, including customer data, pricing, and internal policies, must be treated as confidential and not disclosed to third parties.
This obligation survives termination of the Agreement.
11. LIMITATION OF LIABILITY
H2Hosty shall not be liable for any indirect, incidental, or consequential damages, including loss of revenue, data, or business opportunities.
H2Hosty’s total aggregate liability under this Agreement shall not exceed USD $500.
12. INDEMNIFICATION
You agree to indemnify and hold harmless H2Hosty, its directors, employees, and affiliates against any claims, damages, or expenses arising from:
- Misuse of H2Hosty intellectual property;
- Breach of this Agreement;
- Violation of applicable law or third-party rights.
13. GOVERNING LAW & DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the laws of India.
In the event of a dispute:
- Parties agree to resolve matters through binding arbitration under the Arbitration and Conciliation Act, 1996.
- The arbitration shall be conducted in Mumbai, Maharashtra, in English.
- Each party shall bear its own costs.
- If arbitration is not applicable, the courts of Mumbai, Maharashtra shall have exclusive jurisdiction.
14. MODIFICATIONS
H2Hosty reserves the right to modify this Agreement at any time.
Changes take effect immediately upon posting on our website.
Continued participation in the Affiliate Program constitutes acceptance of the updated terms.
15. MISCELLANEOUS
- Force majeure: H2Hosty is not liable for failure to perform due to events beyond its control.
- Assignment: You may not assign or transfer this Agreement without written consent.
- Entire Agreement: This document constitutes the full agreement between both parties.
- Severability: If any part of this Agreement is held invalid, the remaining sections remain enforceable.
- No waiver: Failure to enforce any term shall not be considered a waiver of that term.
